Investigation Scope and Potential Charges
Florida Attorney General James Uthmeier indicated that his office is actively investigating Dr. Anthony Fauci, exploring potential claims such as fraud, deceptive trade practices, and public nuisance. Uthmeier stated that the inquiry could potentially reveal grounds for criminal liability, and investigators intend to employ "every tool under Florida law" to determine if Fauci engaged in self-dealing or personally benefited from policies enacted during the COVID-19 pandemic.
When questioned about whether he believes Dr. Fauci committed a crime, the Attorney General responded, "I can't say that right now."
"We follow rules of procedure and evidence," Uthmeier explained. "I mean, I could say generally, I think what he did to the American people was horrific. People died because of him. People got hurt because of him. People couldn't be there for the birth of their first child or the loss of a loved one because of him."
"If he is making money on the side while perpetrating this fraud, there could very well be criminal liability," Uthmeier asserted. "But we're going to start with civil, criminal, everything from public nuisance to deceptive trade, to fraud. We're going to look at every aspect of Florida law and do everything in our power to seek truth and accountability."
Attorney General Uthmeier's investigation is currently underway, and no criminal wrongdoing has been formally established at this point.
Federal Pardon and Congressional Actions
Dr. Fauci, who was a key figure in shaping the government's COVID-19 guidance, received a full and unconditional pardon from former President Joe Biden. This pardon covers all actions taken between January 1, 2014, and January 19, 2025. However, it is crucial to note that this federal pardon does not provide protection against prosecution under state law.
These remarks from Uthmeier follow a recent congressional hearing where Dr. Fauci reportedly invoked the Fifth Amendment, declining to answer questions on over 100 occasions.
Subsequently, the Senate Homeland Security and Governmental Affairs Committee, in a vote split along party lines, moved to charge the former chief medical advisor to the president with contempt. This action was taken after his refusal to answer inquiries from members of both political parties, citing concerns about self-incrimination.
"I don't know why you need a pardon if you didn't do anything wrong," Uthmeier commented.
"Dr. Fauci clearly doesn't want to answer questions, but the American people still have a lot of questions, especially Floridians."
