New York City Mayor Threatens Legal Action Over ICE's Alleged Unauthorized Use of City Property
Mayor Zohran Mamdani asserts federal immigration agents are illegally staging operations in municipal parking lots, endangering residents and sowing fear.

New York City Mayor Zohran Mamdani, a Democrat, has issued a warning to the Trump administration, stating his intention to initiate legal proceedings against Immigration and Customs Enforcement (ICE). The mayor's threat stems from allegations that ICE agents have been utilizing municipal parking facilities to conduct immigration enforcement activities without the city's explicit permission.
In correspondence directed to Homeland Security Secretary Markwayne Mullin, acting ICE Director David Venturella, and Kenneth Genalo, the Director of ICE's New York field office, Mayor Mamdani expressed profound concern. He cited reports detailing federal agents' alleged use of New York City-owned sites to organize enforcement operations, characterizing these actions as both unauthorized and unlawful.
This use of City property in furtherance of federal immigration enforcement is unauthorized and is therefore illegal, endangers City residents, and sows fear among those who seek to access City property. If your agents continue any unauthorized use of these lots, New York City will take legal action to prevent this unlawful commandeering of City property.
Allegations of Unauthorized Federal Operations
The mayor's communication specified that ICE agents have reportedly utilized numerous unstaffed, city-owned parking areas for vehicle staging and meetings. These locations include a parking lot within Van Cortlandt Park in the Bronx, and parking lots situated along 111th Street on the western edge of Flushing Meadows Corona Park in Queens. The Queens location is particularly sensitive, as it lies adjacent to a municipal preschool and various cultural establishments that serve hundreds of children and families daily.
Mamdani emphasized:
ICE has not secured any authorization from the City to use these lots for immigration enforcement. To be clear: the City does not authorize ICE using its property in this manner.
He elaborated, stating that:
Parking lots connected to City parks are reserved for the safe use and enjoyment of New Yorkers and visitors who wish to use our parks. Use of these lots for other purposes, including ICE’s reported use of these lots, amounts to unauthorized activity on City property. Accordingly, you must immediately issue guidance to your agents prohibiting them from using any City lots to stage or conduct enforcement operations.
Mayor Mamdani further affirmed New York City's commitment, noting the city "deeply values its immigrant communities and will continue to use all available lawful means to ensure their safety, well-being, and ability to navigate the City and its resources without fear."
Broader Context of Immigration Enforcement Concerns
This recent legal threat follows a similar initiative last month, where Mayor Mamdani, alongside other prominent Democratic leaders in New York, urged private parking facility operators across the city to deny ICE access to their properties.
In a letter addressed to property owners and operators, the mayor's appeal stated:
In solidarity with immigrant New Yorkers and in our shared commitment to the City we love, we ask that you do not rent, lend or otherwise make your property available to ICE as a staging area for its enforcement operations.
The October letter garnered significant political backing, with over 100 elected officials, including Senate Minority Leader Chuck Schumer (D-N.Y.) and House Minority Leader Hakeem Jeffries (D-N.Y.), signing on in support of Mamdani's stance.
Mayor Mamdani has consistently advocated for the abolition of ICE, a position he reiterated following several high-profile incidents. These include the fatal shooting of Mexican national Lorenzo Salgado Araujo by an ICE agent in Houston in July, and another incident last month in New York City where an ICE agent shot and wounded Dominican national Oscar Belgal during an enforcement operation.
